INFORMATION FOR THE PROCESSING OF PERSONAL DATA

 

Pursuant to Art.13 of D.LGS. 30/06/2003 n.196 (hereinafter Privacy Code) and pursuant to Art.13 of EU Regulation n.2016/679 (hereinafter Regulation) and subsequent amendments and additions, with provisions for the protection of individuals and other subjects with regard to the processing of personal data, we wish to inform you in compliance with the aforementioned legislation.

 

  1. DATA CONTROLLER

  1. PURPOSE OF THE PROCESSING

Personal data of natural persons, legal persons, individual firms and/or freelance professionals freely communicated by you are necessary for the conduct of the commercial relationship established with ALVIM Srl and will be treated lawfully and fairly for the following purposes:
- functional purposes for the exercise of rights and the fulfilment of obligations arising from the supply contract and for management purposes;

- fulfillment of legal obligations related to the keeping and conservation of accounting records including the registration of your personal data in the management software in use;

- handling of any complaints and/or disputes;

The processed data are updated, relevant, complete and not exceeding the purposes listed above for which they are collected and subsequently processed.

 

  1. PROCESSING METHODS

The processing of personal data is carried out using manual, computerized and telematic tools and in such a way as to ensure the security and confidentiality of the data. Appropriate prevention and protection systems, constantly updated and verified in terms of reliability, will be used.

 

  1. LEGAL BASIS OF THE PROCESSING

The legal basis of the processing of your personal data is based on the contract between the parties.

The provision of data by you is necessary so that the data controller can provide you with the products requested and satisfy the legal obligations directly linked to the existing contract. Failure to provide and refusal to process such data would make it impossible for ALVIM Srl to establish the commercial relationship and to execute it.

 

  1. LEGITIMATE INTERESTS PURSUED BY THE DATA CONTROLLER

The legitimate interests pursued by the Data Controller are given by having to respect and honor the contractual commitments entered into between the parties. Pursuant to art. 6 of the Regulation the lawfulness of the processing is based on the consent manifestly expressed by the interested party, documented in writing and the need for the execution of a contract of which the Owner is a party.

 

  1. COMMUNICATION OF DATA TO THIRD PARTIES

For the pursuit of the purposes described in the previous points, the personal data provided may circulate in areas attributable to the Data Controller, and may only be handled by staff assigned a specific role as Data Controller and given appropriate instructions. Personal data will be made accessible only to those who, within ALVIM Srl, need it according to their task. These subjects will be properly instructed in order to avoid loss, destruction, unauthorized access or unauthorized processing of the data. In addition, the data may be used by third-party companies that perform instrumental activities on behalf of the Owner such as:

- companies, professionals or other structures providing assistance, advice or collaboration to the Data Controller in accounting, administrative, fiscal, legal, tax and financial matters;

- banks, financial institutions for which the transfer of data is necessary for the performance of the activity in relation to the fulfilment by the Data Controller of the contractual obligations assumed towards you;

- public administrations for the performance of institutional functions within the limits set by law or regulations;

- third-party service providers whose communication is necessary for the performance of the services covered by the contract (e.g. freight forwarders).
Your data may be communicated, as a result of inspections or checks (if required), to all inspection bodies responsible for checks and checks relating to the regularity of legal compliance. Your personal data are not disseminated and will never be published, exposed or made available to indeterminate subjects.

 

  1. RETENTION TIMES

The personal data provided will be kept by the Data Controller for the period necessary for the pursuit of the purposes referred to in the previous points, and for ten years from the termination of the existing commercial relations, except for verification requirements, exercise or defense of the rights of the Data Controller in court, which could lead to a longer retention of data.

 

  1. EXISTENCE OF AUTOMATED DECISION-MAKING

There is no automated decision-making.

 

  1. TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

The Data Controller will not transfer your personal data to a third country or to an international organization, except for third-parties mentioned at art. 6 above, that may be based in other Countries of European Union.

 

  1. RIGHT OF THE DATA SUBJECT

Pursuant to Articles 15 and following of the Regulation, the data Owner has the right to ask the Data Controller, at any time, access to their personal data, rectification or cancellation of the same or to oppose their processing; also has the right to request the restriction of processing in the cases provided for by art. 18 of the Regulation, as well as the right to data portability.

Requests should be addressed in writing by paper mail or e-mail to the controller, at the addresses above.

In any case, the interested party always has the right to lodge a complaint with the competent Supervisory Authority (Guarantor for the Protection of Personal Data), pursuant to art. 77 of the Regulation, if it considers that the processing of your personal data is contrary to the legislation in force.
